Digital Image License Agreement
This Digital Image License Agreement ("Agreement") governs the download and use of digital photographic images ("Images") provided by J5 Media. By downloading any Image, you agree to the terms below.
1. Grant of License
Subject to full payment and compliance with this Agreement, J5 Media grants you a non-exclusive, non-transferable, revocable license to use the Images for personal, non-commercial purposes only, unless a separate written license has been provided.
This license does not constitute a sale of the Images or a transfer of copyright.
2. Permitted Uses
Under this license, you may:
- Download and store the Images for personal use
- Display the Images on personal devices
- Print the Images for personal display
- Share the Images on personal social media accounts, provided no monetary gain is involved and the Images are not altered beyond basic cropping or resizing
3. Prohibited Uses
You may not, without prior written permission from J5 Media:
- Sell, sublicense, lease, assign, or transfer the Images or any rights to them
- Use the Images for commercial purposes, advertising, promotion, branding, or resale
- Use the Images in NFTs, blockchain-based assets, or tokenized products
- Alter, manipulate, or create derivative works beyond basic cropping or resizing
- Remove or obscure any copyright notice, watermark, or metadata
- Submit the Images to stock photography platforms or image repositories
- Use the Images in a defamatory, unlawful, or misleading manner
4. Artificial Intelligence, Machine Learning, and Data Use Restrictions
The Images may not be used, directly or indirectly, for:
- Training, fine-tuning, or improving artificial intelligence systems, machine learning models, neural networks, or similar technologies
- Inclusion in datasets, corpora, benchmarks, or test sets used for AI or algorithmic development
- Automated scraping, crawling, harvesting, or bulk downloading
- Image recognition, facial recognition, biometric analysis, or similar analytical processing
- Generative systems designed to create new images, videos, or derivative content
These restrictions apply whether the use is commercial or non-commercial and whether performed by you or by a third party acting on your behalf.
5. Copyright and Ownership
All Images are protected by United States and international copyright laws. All copyrights and intellectual property rights remain the sole property of J5 Media. No ownership rights are transferred under this Agreement.
6. Attribution
Attribution is appreciated but not required for personal use. If the Images are shared publicly online, crediting J5 Media is encouraged where reasonably possible.
7. No Guarantees
Images are provided "as-is" without warranties of any kind, express or implied. J5 Media does not guarantee suitability for any particular purpose.
8. Limitation of Liability
To the maximum extent permitted by law, liability for any claim arising from the use of the Images shall not exceed the amount paid for the Images. J5 Media is not liable for indirect, incidental, or consequential damages.
9. Termination
This license automatically terminates if you violate any term of this Agreement. Upon termination, you must delete all copies of the Images in your possession or control and certify deletion upon request.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the applicable jurisdiction where J5 Media is registered, without regard to conflict of law principles.
11. Acceptance
By downloading the Images, you acknowledge that you have read, understood, and agree to be bound by this Digital Image License Agreement.
