Terms of Sale - Photography Prints

These Terms of Sale govern the purchase of photographic prints and related products made available through this website. By placing an order, you agree to be bound by these terms.

1. Orders and Acceptance

All orders are subject to acceptance and availability. An order is not considered accepted until payment has been successfully processed and you receive an order confirmation. We reserve the right to refuse or cancel any order at our discretion, including but not limited to pricing errors, suspected fraud, or product availability issues.

2. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated. Prices do not include applicable taxes, shipping, or handling fees, which will be calculated at checkout. Payment is due in full at the time the order is placed. We do not begin production until payment is received.

3. Custom and Made-to-Order Products

All photographic prints are produced on a made-to-order basis. Because prints are custom-produced, all sales are final once production begins. Please review sizes, finishes, and image selections carefully before submitting your order.

4. No Returns or Exchanges

Due to the custom nature of photographic prints, we do not accept returns or exchanges for reasons including but not limited to change of mind, incorrect size selection, or subjective dissatisfaction. This does not affect your rights related to damaged or defective items as described below.

5. Damaged or Defective Items

If your order arrives damaged or defective, you must notify us within 7 days of delivery. To be eligible for a replacement, you may be required to provide photographs of the damaged packaging and product. At our discretion, we will replace the item or issue a refund. Shipping damage claims submitted after this period may not be honored.

6. Shipping and Delivery

Estimated delivery times are provided for convenience only and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, customs processing, or other factors outside our control. Risk of loss transfers to the buyer upon delivery to the carrier.

7. Color and Display Variations

Colors may vary between printed products and on-screen previews due to differences in monitors, color profiles, lighting conditions, and printing processes. Minor color variation does not constitute a defect.

8. Intellectual Property and Usage Rights

All photographs remain the intellectual property of the photographer. Purchase of a print does not transfer copyright or grant any rights to reproduce, distribute, or commercially exploit the image. Prints are for personal display use only unless otherwise agreed in writing.

9. Limitation of Liability

To the maximum extent permitted by law, our liability for any claim arising from the sale of photographic prints is limited to the purchase price of the item. We are not liable for indirect, incidental, or consequential damages.

10. Governing Law

These Terms of Sale are governed by and construed in accordance with the laws of the applicable jurisdiction where the business is registered, without regard to conflict of law principles.

11. Modifications

We reserve the right to update or modify these Terms of Sale at any time. The version in effect at the time of purchase will apply to your order.
